GENERAL TERMS AND CONDITIONS OF USE FOR THE LIKESPORT APPLICATION

These Terms and Conditions govern the use of the LIKESPORT Application (hereinafter referred to as "the Application"), created and managed by the company LIKESPORT CONNECT LSC SL, Number 4048804, whose registered office is located at: Cami dels Plans,34, balco Casamanya casa 3; Escas, AD400 La Massana represented by its President Mr. Alexandre BRESSY. 

By accepting these terms and conditions when registering, the User confirms that he/she has read, understood and accepted the content of these Terms and Conditions.

Article 1. Definitions

"Application" refers to the LIKESPORT platform, published by LIKESPORT ;

"CGU" refers to these General Terms and Conditions of Use;

"Chat" refers to the Application's instant messaging service; 

"Club" means any club 

"Account" refers to the account that must be created in order to become a User and access the services offered by the Application;

"Executive" means any person at the head of a Club;

"Player" refers to any User of the Application who is registered with a Club;

"Services" refers to all the functionalities offered by the Application;

"User" refers to any person who has an Account and access to the Application, whether as a Manager, Player or other.

Article 2. Scope of application

These terms and conditions govern the relationship between any User and LIKESPORT. 

They apply to all Services offered by the Application, to the exclusion of all other conditions. 

The French version of these Terms and Conditions prevails over any other version.

Article 3. Subject

LIKESPORT is a mobile application whose purpose is : 

  • provide general information on the world of sport, 
  • help clubs with their communications and management.  

LIKESPORT reserves the right to modify the services provided on the Application at any time.

Article 4. Registration to the Application and creation of a User Account 

  • Article 4.1 Application registration conditions 

Use of the Application is open to both minors and adults.

However, the use of the Application by a minor is subject to the issue of an authorization from his/her legal representative(s). The authorization form is available by clicking on the following link: 

Under no circumstances shall LIKESPORT be held liable in the event of use of the Application by a minor who does not have authorization signed by his or her legal representative(s). 

In any event, LIKESPORT reserves the right to suspend the Account, to limit access to the Application or to terminate these GCU, in the event of use of the Application by a minor without such authorization.

  • Article 4.2 Account creation and access to Services

In addition to acceptance of these Terms and Conditions and the LIKESPORT Privacy Policy, access to all Services is subject to the opening of an Account.

The User must create an Account using the form provided for this purpose and by filling in all the mandatory fields on the form. He then specifies his profile category from the list of choices offered. 

The User must provide correct, complete and updated information in order to open an Account on a regular basis. The User must inform LIKESPORT of any changes affecting such information.

Any entry of false, inaccurate, obsolete or incomplete information, or of a User name or nickname containing terms contrary to a regulation or legislation in force, may result in the closure of the User's Account. LIKESPORT may not be held liable in any way in this respect. 

The identifier must not be used by a third party without the User's consent. 

The User undertakes to keep secret the password chosen when creating his Account and not to communicate it to anyone.

The User is responsible for managing and safeguarding his/her password and login. LIKESPORT shall not be held liable for any damage caused by the User's negligence. 

In the event of misappropriation or fraudulent use of an identifier by a third party, the User agrees to immediately inform LIKESPORT so that LIKESPORT may block the Account and/or delete it.

By creating an Account, the User agrees to receive notifications necessary for the proper functioning of the Application. 

Opening an Account is free of charge (excluding any connection costs, which depend on the electronic communication operator).

Article 5. Description of Services 

  • Article. 5.1. General features

The Application provides all Users with a general news feed concerning the chosen sports, managed and updated by the LIKESPORT teams.

It also allows you to create and follow one or more sports clubs.

Users can also access the news feed and agenda of the Club to which they belong and/or of the Club(s) they have defined as "favorites". These news feeds and agendas are maintained by the Clubs concerned.

  • Article. 5.2. Messaging

The Application provides all Users with an instant messaging service in the form of Chat.

Chat enables direct contact between Players, between Clubs, or between Players and Clubs.

The User may also create discussion groups.

  • Article. 5.3. Club area

The Club Area centralizes all information relating to a given Club.

It displays information about the Club (presentation of the Club, contact details, organization chart, gymnasium, etc.) and its team(s) (presentation of players, calendar of matches, events or training sessions, etc.), filled in and updated by the Club, as well as storing administrative documents such as registration forms, sports licenses, medical certificates, parental authorizations, etc.

Each Club has its own Boutique, enabling it to display the products it offers for sale. The Boutique is simply a place where people can get in touch with each other, and does not allow any on-line payment to be made.

The Club Area also offers the opportunity to present the Club's various partners and sponsors.

Any player belonging to a Club team may apply for membership.

Once a member, any player can access the various documents made available by the Club from this area (registration forms, license forms, etc.).

Article 6. Commitments of Users

  • Article 6.1. Commitments of all Users

The User acknowledges that he is solely responsible for complying with all laws, regulations and obligations applicable to his use of the Application.

Furthermore, by using the Application, the User undertakes to : 

  • Indemnify and hold harmless LIKESPORT from and against any and all third party claims for which the User may be liable and for any and all damages caused by the User's failure to perform its obligations. Accordingly, the User shall indemnify and hold LIKESPORT harmless against any third party claims resulting from the User's negligence. In the event of legal proceedings, the User shall reimburse LIKESPORT for all costs related to such proceedings (including, without limitation, attorney's fees, court costs, bailiff's fees, expert fees, etc.);
  • Not to make any comments, behave in any way or publish any content on the Application that is defamatory, abusive, obscene, pornographic, vulgar, offensive, aggressive, inappropriate, violent, threatening, harassing, racist, xenophobic or sexually oriented, inciting violence, discrimination or hatred, encouraging activities or the use of illegal substances or, more generally, contrary to the purposes of the Application, likely to infringe the rights of
    LIKESPORT or a third party or contrary to accepted standards of behaviour;
  • Not to infringe the rights and image of LIKESPORT, in particular its intellectual property rights;
  • Not to open more than one account on the Application and not to open an account in the name of a third party without their express prior authorization;
  • Comply with these Terms and Conditions.
  • Article 6.2. Club commitments 

In addition to the commitments mentioned in article 6.1, the Club also undertakes to : 

  • Provide LIKESPORT with its logo so that it may appear on all communications concerning the Club;
  • Comply with all applicable laws and regulations;
  • Respect the image and privacy rights of players and all other persons involved in the Club or its events;
  • Ensure that its insurance covers the activity, event or outing it proposes for all Users attached to the Club;
  • Behave appropriately and responsibly during the activity, event or outing;
  • Ensuring the safety of Users attached to the Club. 
  • Article 6.3. Players' commitments 

In addition to the commitments mentioned in article 6.1, the Player undertakes to : 

  • Provide LIKESPORT with information that is not misleading, 
  • Behave appropriately and respectfully when using the Application's messaging system and posting comments.

Article 7. Obligations of LIKESPORT

  • Article 7.1. Availability of the Application 

LIKESPORT undertakes to make the Services available to Users. 

LIKESPORT will use its best efforts to keep the Application accessible without untimely interruption. However, maintenance, security or other planned actions and/or irresistible events (e.g. interruption in public communication networks, power failure), may cause temporary interruptions or other service failures.

LIKESPORT will endeavor to ensure the availability of the Application 24 hours a day, 7 days a week, subject to any planned maintenance requiring temporary technical interruption. Access is considered unavailable when one or more elements of the Application are interrupted for reasons other than planned maintenance, resulting in the total unavailability of the Application. 

LIKESPORT cannot guarantee 100% continuous availability of the Application due to the potential occurrence of external events (cyber-attack, hosting failure, etc.), the obligation of availability of the Application constitutes a simple obligation of means. LIKESPORT will use its best efforts to restore access to the Application within a reasonable time. 

LIKESPORT may, by operation of law, suspend or block access to all or part of the Application and/or the Services in the following cases, subject to 2 business days' notice or without notice if the situation presents a serious emergency:

  • To comply with any law, regulation, court order, or demand or injunction requiring immediate action;
  • To avoid any interference that could damage or impair LIKESPORT equipment .
  • Article 7.2. Maintenance of the Application

LIKESPORT undertakes to maintain the Application at all times so as to enable Users to use the Services in the conditions normally expected. 

  • Article 7.3. Securing 

LIKESPORT warrants that it has put in place physical and logical security measures appropriate to the nature of the data stored and taking into account the risks incurred, in accordance with the state of the art.

The User acknowledges that LIKESPORT cannot guarantee 100% data security and that the obligation of security is an obligation of reinforced means.  

Article 8. Account Suspension and Access Limitation 

  • Article 8.1. Account deletion by a Player

A User may delete his or her Account at any time. 

Upon deletion, the User will no longer be able to access any of the Services. 

If the User wishes to reconnect after having deleted his Account, he must recreate a new Account.

  • Article 8.2. Deleting a Club Account

A User or Administrator cannot delete a Club Account on his or her own. He/she must make a request to LIKESPORT, who will take care of deleting the account.

Deletion of a Club Account automatically terminates the attachment of all Users linked to that Club. Upon deletion, Users who were attached to this Club will no longer be able to access any of the Services, unless they request to be attached to another Club. 

  • Article 8.3. Limitation of access and deletion of the Account by LIKESPORT

In the event of a User's breach of these TOU, including its obligations set forth in Section 6, or if LIKESPORT has reasonable grounds to believe that such action is necessary to protect the safety and integrity of LIKESPORT, its Users or third parties, or for fraud prevention or investigation purposes, LIKESPORT reserves the right to :

  • Prevent the publication or delete any message or content published by said User on the Application, and/or ;
  • Restrict access to and use of the Application, and/or ;
  • Temporarily or permanently suspend an Account.

LIKESPORT will decide, at its sole discretion, whether or not to lift the measures in place.

Article 9. Free of charge - paid version

Access and registration to the Application are free unless the User has opted for a paid version. As the Shop is simply an interface between Users and commercial partners, no financial transaction can be carried out via the Application.

If a User opts for a paid version, the User will be required to pay the monthly price specified in the paid offer. In return, he/she will benefit from the additional services and functionalities specified in the offer. The monthly subscription fee is payable in advance by credit card via a secure payment platform or by PayPal account. Any delay in payment of more than 15 days will result in suspension of the User's Account. If the User fails to pay within 15 days of a formal notice from LIKESPORT, LIKESPORT may permanently cancel the User's Account. 

Article 10. Cookies and advertising banners

The Application uses cookies and tracers.

Cookies are small text files stored in the browser of the User's terminal when he or she uses a website, enabling the User's terminal browser to be recognized and information to be stored for the duration of the cookie's validity. 

When consulting the Application, information relating to the User's navigation may be recorded in "Cookies" files installed on the User's terminal.

These cookies are issued by LIKESPORT in order to facilitate the User's navigation on the Application. 

Unless the User decides to deactivate cookies, the User accepts that the Application may use them.

The User may deactivate these cookies at any time, free of charge, using the appropriate settings on his or her Internet browser, although this will prevent access to the Services.

The User accepts that the Application may display advertising messages from third-party advertisers, in banners displayed when using the Application. It is specified that the advertisements displayed by the Application are not designed to exploit personal data processed by the Application. The User does not have the option of deactivating these advertisements.   

Article 11. Intellectual property rights

LIKESPORT is the owner of all trademarks, logos, graphics, photographs, animations, videos and texts contained on the Application, excluding content provided by Users. They may not be reproduced, used or represented without the express authorization of LIKESPORT, on pain of legal proceedings.

In particular, the User agrees not to modify, copy, reproduce, download, broadcast, transmit, commercially exploit or distribute in any way whatsoever the Services, the pages of the Application or the computer codes of the elements making up the Services and the Application.

Any content provided by the User that is subject to intellectual property rights is licensed to LIKESPORT for use, in particular Club logos. This license includes in particular the right for LIKESPORT to reproduce, represent, adapt, translate, digitize and use them on all media for the purposes of providing the Services. By creating an Account, the Club agrees to provide its logo to LIKESPORT so that it may appear on all communications concerning the Club. 

Article 13. Right of use

The User grants LIKESPORT all the rights necessary for the provision of the Services, including in particular :

  • The right to store in electronic form any content downloaded or posted by the User via the Application; 
  • The right to make these accessible to other Users and to disclose them to other Users by way of downloading. 

The User guarantees either that he is the owner of the intellectual property rights to any content downloaded, or that he has received all necessary authorizations to use or publish said content. 

ARTICLE 14. exclusions and limitation of liability 

The User is requested to carefully read the present article which limits the liability of LIKESPORT s liability.

The Application is made available as is, with any imperfections. Use of the Application is at the User's sole discretion and risk. 

LIKESPORT is in no way responsible for any content that may be posted by third parties, including content posted by other Users. Consequently LIKESPORT cannot be held liable for any loss or damage whatsoever that may result from the actions or omissions of third parties, including, for example, if another User is guilty of misusing content, another User's identity or personal information.

Information, documents and content of any kind from Clubs and Users in general are published and/or stored on the Application under their sole responsibility, LIKESPORT acting as a mere host within the meaning of the French Law for Confidence in the Digital Economy (Loi pour la Confiance dans l'Economie Numérique).

In the event of abusive or illicit content, it is up to each User to report it to LIKESPORT using the contact e-mail address: contact@like-sport.com. Provided that the abusive or illicit content is precisely identified, LIKESPORT will remove the said content as quickly as possible. The responsibility of LIKESPORT may only be held liable in the event that LIKESPORT does not promptly remove abusive or illicit content that has been reported to it by a User in the required manner.

The Application may contain links to other websites. LIKESPORT has no control over third-party sites and does not endorse them. Accordingly LIKESPORT cannot be held responsible for the availability or content of such third-party sites, which the User uses at his/her own risk.

The responsibility of LIKESPORT can only be held liable for a proven fault directly attributable to it, having caused direct and certain harm to a User.

LIKESPORT shall in no event be liable for any indirect, special or consequential damages including, without limitation, lost profits, business interruption, loss of reputation, loss of information or data.

LIKESPORT declines all responsibility for the presentation, content and running of the events and activities offered by the Clubs. LIKESPORT cannot be held responsible, in particular, for the accuracy of the information contained in the organizers' advertisements, or in the event of theft or accidents occurring during an event or sports meeting. All claims will be forwarded to the organizer concerned, who will assume full and sole responsibility.

Article 15. Personal data 

In order to offer its Services, LIKESPORT processes personal data. Information on how LIKESPORT handles such data is contained in LIKESPORT's Privacy Policy.

Article 16. Modification of the GCU

These TOU express the entire agreement between the User and LIKESPORT with respect to the use of the Services. Any other document, in particular any mention on the Application, is for information purposes only.

LIKESPORT may modify these Terms and Conditions of Use in order to adapt to its technological and commercial environment and to comply with applicable regulations. Any changes to these TOS will be posted on the Application with an indication of the date of update and will be notified to you by LIKESPORT prior to coming into effect.

Article 17. Disputes 

Before taking any legal action, LIKESPORT invites Users to use the contact e-mail: contact@like-sport.com, to express their dissatisfaction in order to find an amicable solution. In particular, the User may contact LIKESPORT in the event of technical problems or miscellaneous questions.

All disputes arising from the use of the Application shall be governed by French law. 

Online Dispute Resolution application: In accordance with Article 14 of Regulation (EU)No. 524/2013, the European Commission has set up an Online Dispute Resolution application, facilitating the independent out-of-court settlement of online disputes between consumers and professionals in the European Union.

Should mediation fail, the dispute will be brought exclusively before the Commercial Court if the User is a professional.

If one or more articles of these General Terms and Conditions are held to be invalid or declared as such in application of a law, regulation or decision that has become final, the other articles shall retain all their force and scope.
